Uniform and Complaint Procedures

UNIFORM COMPLAINT PROCEDURES ABOUT PROGRAMS, EMPLOYEES, OR PROCEDURES. The Ocean View School District has the primary responsibility to insure compliance with applicable state and federal laws and regulations. A pupil in a public school shall not be required to pay a pupil fee for participation in an educational activity. Ocean View has a Uniform Complaint Process which is followed by parents/guardians, students, staff, site and/or district advisory committees or other interested parties. The Uniform Complaint Procedures apply to the filing, investigation and resolution of complaints regarding alleged:  1) failure to comply with federal or state law or regulations governing consolidated categorical aid programs, migrant education, child care and developmental programs, child nutrition programs and special education programs; 2) unlawful discrimination in any program or activity based on actual or perceived characteristics of race or ethnicity, color, ancestry, nationality, national origin, ethnic group identification, age, religion, marital or parental status, physical or mental disability, sex, sexual orientation, gender, gender identity, gender expression, or genetic information; the perception of one or more of such characteristics; or association with a person or group with one or more of these actual or perceived characteristics; 3) failure to comply with school safety planning requirements; 4)unlawful discrimination, harassment, intimidation, and bullying based on actual or perceived characteristics of race or ethnicity, color, ancestry, nationality, national origin, ethnic group identification, age, religion, marital or parental status, physical or mental disability, sex, sexual orientation, gender, gender identity, gender expression, or genetic information; the perception of one or more of such characteristics; or association with a person or group with one or more of these actual or perceived characteristics; 5)unlawful imposition of pupil fees for participation in educational activities. A copy of the complaint policy is available at each school site as well as in the Assistant Superintendent-Administrative Service’s office. 

 

To make a complaint, we recommend first meeting with the Principal. The Principal is responsible for processing complaints. If not satisfied, please ask the Principal for the Uniform Complaint policy and procedure. Copies of Ocean View School District’s complaint procedures are free of charge. The person responsible for processing complaints at the school district level is the Assistant Superintendent – Administrative Services, at 488-4441, 4200 Olds Road, Oxnard, CA 93033. The Ocean View School District shall investigate and seek to resolve complaints using policies and procedures known as the Uniform Complaint Procedures (UCP) adopted by our local board. 

 

It is the policy of the district that no person suffer any form of retaliation as a result of making a complaint. Complaints alleging discrimination, harassment, intimidation, or bullying, must be filed within six (6) months from the date the alleged discrimination, harassment, intimidation, or bullying, occurred or the date the complainant first obtained knowledge of the facts of the alleged discrimination, harassment, intimidation, or bullying, unless the time for filing is extended by the superintendent or his or her designee.

 

Complaints will be investigated and a written decision or report will be sent to the complainant within sixty (60) days from the receipt of the complaint. This sixty (60) day time period may be extended by written agreement of the complainant. The complainant has a right to appeal the District’s decision to the California Department of Education (CDE) by filing a written appeal within 15 days of receiving the District’s decision. The appeal must include a copy of the complaint filed with the District and a copy of the District’s decision.

 

The time line for seeking civil law remedies in discrimination, harassment, intimidation or bullying complaints stipulates that the complainant may not pursue such remedies until 60 days after filing an appeal to the California Department of Education. Civil law remedies may be available under state or federal discrimination, harassment, intimidation, or bullying laws, if applicable. Complainants may seek assistance from mediation centers or public/private interest attorneys. (Title V California of Regulations §4622 & E.C. 32289 & 33308.1, E.C. 220)
